CONDITIONS OF THE PROPERTY. 4.1 For the purposes of this Agreement, the parties agree that the Property is sold in an “as is condition” and the City makes no warranty or representation as to the developability of the Property, nor with respect to any soil conditions or other geotechnical considerations or services available to the Property, and the Purchaser further acknowledges that the Purchaser has inspected the Property and is aware of all physical and legal aspects pertaining to the Property, and that this agreement contains the entire agreement between the parties and cannot be modified in any way except by further agreement in writing, signed by each of the parties hereto. 4.2 The Purchaser shall adhere to the requirements outlined in the Zoning By-law No. 5045, as amended, and the Xxxxx Business District Phase 2 Area Development Plan By-law No. 4931.
