Common use of Conditions Precedent to Initial Purchase Clause in Contracts

Conditions Precedent to Initial Purchase. The initial Purchase under this Agreement is subject to the conditions precedent that (a) Buyer shall have received on or before the date of such Purchase those documents listed on Schedule A and (b) all of the conditions to the initial purchase under the Purchase Agreement shall have been satisfied or waived in accordance with the terms thereof.

Conditions Precedent to Initial Purchase. The initial Purchase under this Agreement on the Restatement Date is subject to the conditions precedent that (a) Buyer shall have received on or before the date of such Purchase purchase those documents listed on Schedule A and (b) all of the conditions to the initial purchase under Amendment No. 1 to the Purchase Agreement shall have been satisfied or waived in accordance with the terms thereof.

The initial Purchase under this Agreement is subject to the conditions precedent that (a) Buyer Finance Subsidiary shall have received on or before the date of such Purchase purchase those documents listed on Schedule A D and (b) all of the conditions to the initial purchase under the Receivables Purchase Agreement shall have been satisfied or waived in accordance with the terms thereof.

The initial Purchase under this Agreement is subject to the conditions precedent that (a) Buyer shall have been capitalized with the Initial Contributed Receivables, (b) Buyer shall have received on or before the date of such Purchase purchase those documents listed on Schedule A and (bc) all of the conditions to the initial purchase under the Purchase Credit and Security Agreement shall have been satisfied or waived in accordance with the terms thereof.

Conditions Precedent to Initial Purchase. The initial Purchase under this Agreement is subject to the conditions precedent that (a) Buyer Transferee shall have received on or before the date of such Purchase those documents listed referenced on Schedule A to be received by or on behalf of Transferee and (b) all of the conditions to the initial purchase under the Purchase Agreement shall have been satisfied or waived in accordance with the terms thereof.

The initial Purchase under this Agreement is subject to the conditions precedent that (a) Buyer shall have received on or before the date of such applicable Purchase Date those documents listed on Schedule A and (b) all of the conditions to the initial purchase under the Purchase Agreement shall have been satisfied or waived in accordance with the terms thereof.

The initial Purchase under this Agreement is subject to the conditions precedent that (a) Buyer shall have received on or before the date of such Purchase those documents listed on Schedule A and (b) all of the conditions precedent to the initial purchase Incremental Purchase under the Purchase Agreement shall have been satisfied or waived in accordance with the terms thereof.

The initial Purchase under this Agreement is subject to the conditions precedent that that: (a) Buyer shall have received on or before the date of such Purchase those documents listed on Schedule A and A, (b) all of the conditions to the initial purchase Credit Event under the Purchase Agreement shall have been satisfied or waived in accordance with the terms thereofthereof and (c) Originator shall have marked its books and records with a legend satisfactory to Buyer (and the Administrative Agent, pursuant to the terms of the Purchase Agreement) identifying Buyer’s ownership interest in the Receivables, Related Security and Collections.
