Common use of CONDITIONS PRECEDENT TO LESSEE'S OBLIGATIONS Clause in Contracts

CONDITIONS PRECEDENT TO LESSEE'S OBLIGATIONS. The Lessee's obligation to participate in the transactions contemplated hereby is subject to the conditions that, prior to or on the Refunding Date, the Lessee shall have received the certificates and other documents which are referred to in, or the opinions to be addressed to it under, as the case may be, paragraphs (d), (g)(ii)-(vii), (h)(ii)-(iv), (j), (k) and (l)(ii)-(viii) of Section 4.01 hereof and the Underwriters shall have made available the amounts required to be paid by them pursuant to Section 2.01 hereof.
