Conditions Precedent to Submission of a Claim to Arbitration. 15.1 In respect of a claim that the Defending Party has breached an obligation under Chapter II, other than an obligation under Article 9 [Entry and Sojourn of Personnel] and Article 10 [Transparency], a disputing investor may commence a proceeding under this Chapter by transmitting a written request for consultations and negotiations ("written request") to the Defending Party.
