Common use of Conditions to Company’s Obligation Clause in Contracts

Conditions to Company’s Obligation. The obligation of Company to consummate the sale of the Subordinated Note and to effect the Closing is subject to delivery by Purchaser to Company of this Agreement, duly authorized and executed by Purchaser, and the purchase price in an amount equal to the Subordinated Note Amount.

Conditions to Company’s Obligation. The 3.3.1. With respect to a given Noteholder, the obligation of Company to consummate the sale of the Subordinated Note Notes and to effect the Closing is subject to delivery by Purchaser or at the direction of such Noteholder to Company (or written waiver of such delivery by Company prior to the Closing) of this Agreement, duly authorized and executed by Purchaser, and the purchase price in an amount equal to the Subordinated Note Amountsuch Noteholder.

Conditions to Company’s Obligation. The obligation of Company to consummate the sale of the Subordinated Note and to effect the Closing is subject to delivery by Purchaser to the Company of this Agreement, duly authorized and executed by such Purchaser, and the purchase price from the Purchaser in an amount equal to the stated principal amount of the Subordinated Note AmountNote.
