Common use of – CONDITIONS TO FINALITY OF SETTLEMENT Clause in Contracts

– CONDITIONS TO FINALITY OF SETTLEMENT. This Settlement shall be contingent upon each of the following conditions in this Article 11 being satisfied. The Settling Parties agree that if any of these conditions is not satisfied, then this Settlement Agreement is terminated (subject to Defendants’ right to waive the condition set forth in Section 11.4) and the Class Action will, for all purposes with respect to the Settling Parties, revert to its status as of the Settlement Agreement Execution Date.

– CONDITIONS TO FINALITY OF SETTLEMENT. This Settlement shall be contingent upon each of the following conditions in this Article 11 10 being satisfied. The Settling Parties agree that if any of these conditions is not satisfied, then this Settlement Agreement is terminated (subject to Defendants’ right to waive the condition conditions set forth in Section 11.410.3 and 10.5) and the Class Action will, for all purposes with respect to the Settling Parties, revert to its status as of the Settlement Agreement Execution DateCourt Order entering the stay on January 16, 2024, at ECF Dkt. 258.
