CONDITIONS TO SELLER'S AND BUYER'S OBLIGATION TO CLOSE. The obligations of Seller and Buyer to close under this Agreement as to a particular Property are subject to the fulfillment, prior to or at Closing, of the following: that there shall not be in effect any statute, regulation, order, decree or judgment of any governmental entity having jurisdiction which renders illegal or enjoins or prevents the sale of such Property to Buyer. In no event shall the failure of this condition as to a particular Property be a condition to Buyer's or Seller's obligations hereunder with respect to another Property.
