Common use of Conduct of a claim pending dispute resolution Clause in Contracts

Conduct of a claim pending dispute resolution. Pending resolution of any coverage dispute and without prejudice to any issue in dispute, the Insurer will, if so directed by the Law Society of England and Wales at the request of an Insured, conduct any Claim, advance Defence Costs and, if appropriate, compromise and pay the Claim. The Society will only give such direction if it is satisfied in good faith that there is a reasonable prospect that the coverage dispute will be resolved or determined in the Insured's favour and that it is fair and equitable in all the circumstances for such direction to be given.
