Common use of Confidential Agreement Clause in Contracts

Confidential Agreement. Except for any disclosure required by applicable law or rules of the SEC, the Company and each Purchaser shall, and shall direct its respective representatives to, hold in confidence all information concerning this Agreement and the transactions contemplated hereby until the earlier of such time as (i) the Company has made a public announcement concerning the Agreement and the transactions contemplated hereby or (ii) this Agreement is terminated.

Confidential Agreement. Except for any disclosure required by applicable law or rules of the SECSEC or NASD, the Company and each Purchaser shallwill, and shall will direct its respective representatives to, hold in confidence all information concerning this Agreement and the transactions contemplated hereby placement of shares hereunder until the earlier of such time as (i) the Company has made a public announcement concerning the Agreement and the transactions contemplated hereby placement of shares hereunder or (ii) this Agreement is terminated.
