Confidential Information; Unauthorized Disclosure. During the period of his employment hereunder and for any period following the termination of employment, the Employee shall not, whether during the period of his employment hereunder or thereafter, without the written consent of the Board or a person authorized thereby, disclose to any person, other than an employee of Company or a person to whom disclosure is reasonably necessary or appropriate in connection with the performance by the Employee of his duties as an executive of Company, any confidential information obtained by him while in the employ of Company with respect to Company's business, including but not limited to technology, know-how, processes, maps, geological and geophysical data, other proprietary information and any information whatsoever of a confidential nature, the disclosure of which he knows or should know will be damaging to Company; provided, however, that confidential information shall not include any information known generally to the public (other than as a result of unauthorized disclosure by the Employee) or any information which the Employee may be required to disclose by any applicable law, order, or judicial or administrative proceeding.

During the -------------------------------------------------- period of his employment hereunder and for any the period ending one year following the termination of employment, the Employee shall not, whether during the period of his employment hereunder or thereafter, without the written consent of the Board of Directors or a person authorized thereby, disclose to any person, other than an employee of the Company or a person to whom disclosure is reasonably necessary or appropriate in connection with the performance by the Employee of his duties as an executive of the Company, any confidential information obtained by him while in the employ of the Company with respect to the Company's business, including but not limited to technology, know-how, processes, mapspipeline terminalling and marketing customers practices, geological or operations, and geophysical data, other proprietary information and any information whatsoever of a confidential natureinformation, the disclosure of which he knows or should know will be damaging to the Company; provided, provided however, that confidential information shall not include any information known generally to the public (other than as a result of unauthorized disclosure by the Employee) ), any information of a type not otherwise considered confidential by persons engaged in the same business or a business similar to that conducted by the Company, or any information which the Employee may be required to disclose by any applicable law, order, or judicial or administrative proceeding.
