Confidentiality of PHI. BCN will maintain the confidentiality of all Protected Health Information (PHI) BCN creates or receives for, on behalf of, or from GHP (or another business associate of GHP) in the performance of its duties under the ASC and this BA Agreement. BCN will neither use nor disclose PHI except (1) as this BA Agreement permits or requires, (2) as GHP permits or requires in writing, (3) as an Enrollee authorizes, or (4) as Required by Law.
Confidentiality of PHI. Seller acknowledges that Purchaser may create or access protected health information ("PHI") as defined in 45 CFR 160.103. Seller agrees to advise its employees, agents and/or subcontractors (collectively “personnel”) that, should such personnel be incidentally exposed to or incidentally access PHI, such personnel must maintain the PHI in strictest confidence. Confidentiality of PHI. Both parties warrant that they will maintain and protect the confidentiality of all individually identifiable health information specifically relating to Participants (“Protected Health Information” or “PHI”) in accordance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and all applicable federal and state laws and regulations. However, nothing herein will limit either party’s use of any aggregated Participant information that does not contain PHI. This paragraph will survive the termination of this Agreement.
Confidentiality of PHI. Business Associate shall comply with all applicable Federal and State laws and 34 regulations relating to maintaining and safeguarding the confidentiality of PHI.
