Conflict with Plan Document. The rights, duties, responsibilities, obligations and liabilities of the Trustee are as set forth in this Trust Agreement, and no provision of the Plan(s) or any other documents shall affect such rights, responsibilities, obligations and liabilities. If there is a conflict between provisions of the Plan(s) and this Trust Agreement with respect to any subject involving the Trustee, including but not limited to the responsibility, authority or powers of the Trustee, the provisions of this Trust Agreement shall be controlling.
Conflict with Plan Document. Company acknowledges that in the event there is a conflict between the provisions of a Custodial Agreement executed by a Participant and the 403(b) Plan document, the provisions of the 403(b) Plan shall prevail.
