Conflicts; Continuing Effect of Transaction Documents. In the event of any conflict between the terms of this First Amendment and the LLC Agreement, the terms of this First Amendment shall control. Except as otherwise expressly provided herein, the execution, delivery, and performance by the parties hereto of this First Amendment shall not constitute a waiver, permit, consent or approval of any kind or character with respect to the LLC Agreement, as amended hereby.
