Conformance to Specifications. Bidders offering item(s) other than the Bid Standard (as defined in Section 3 of the General Terms and Conditions below) shall indicate manufacturer's name and model numbers of item(s) being offered and include descriptive literature of such material when submitting their proposals. Failure to comply with this procedure will obligate the successful Bidder (the "Vendor") to furnish the Bid Standard item at the unit price submitted. If requested by the Authority representative, sample(s) of such item(s) must be submitted, at no charge, within ten days after request. Failure to comply will cause the bid to be considered non-responsive.
Conformance to Specifications. Contractor represents, covenants, and warrants it can and will perform the Services in a timely manner according to this Contract.

Bidder agrees and warrants that whenever the bidder, in its Bid, describes goods by trade name, catalog number, or "as per sample", the goods so described conform to the specifications. The unauthorized use of any patented articles is done entirely at the risk of the successful bidder.

Insys will order the Product from a third party manufacturer for shipment to Mylan in accordance with the Specifications set forth in the ANDA, as such regulatory approval may be amended or supplemented from time to time, and applicable Law. Mylan shall be promptly and fully advised of any new instructions or Specifications required by the FDA or by Law and the Parties shall confer with respect to the best mode of compliance with such requirements.
Conformance to Specifications. GoerTek will manufacture Products to be 100% in conformance with the Specifications and Plantronics' quality acceptance requirements as identified in the each Development and/or Manufacturing Program or other documentation as provided by Plantronics. GoerTek will only use components and materials that are qualified and approved by Plantronics on manufacturing of Products. GoerTek will ensure that the Products meet quality acceptance requirements and functional tests as required in the applicable Development Manufacturing Program. GoerTek must maintain an inspection procedure and quality assurance program for the Products to ensure compliance with the requirements under this Section 9.1. GoerTek s failure to comply with quality requirements will be a material breach of this Agreement. The quality requirements are set forth at Exhibit G hereof and as Exhibit G may hereafter be updated.
Conformance to Specifications. All Products sold hereunder shall conform to McDATA's Specifications as reflected on the respective purchase order, as acknowledged by SCI, and to IPC Class 2 standards.

During the Term of this Agreement, and subject to the terms and conditions of this Agreement, EDT shall cause Contract Manufacturer to formulate, fill and package the Product in accordance with the Product Specifications and Labeling requirements of SM. Conformance to Specifications. All Goods provided by Contractor to Company shall conform to Company’s applicable specifications, drawings, samples or other descriptions. Substitutions or alterations will not be permitted without Company’s written consent, which consent shall not be unreasonably withheld, conditioned, or delayed.
