Common use of Conformance to Specifications Clause in Contracts

Conformance to Specifications. Bidders offering item(s) other than the Bid Standard (as defined in Section 3 of the General Terms and Conditions below) shall indicate manufacturer's name and model numbers of item(s) being offered and include descriptive literature of such material when submitting their proposals. Failure to comply with this procedure will obligate the successful Bidder (the "Vendor") to furnish the Bid Standard item at the unit price submitted. If requested by the Authority representative, sample(s) of such item(s) must be submitted, at no charge, within ten days after request. Failure to comply will cause the bid to be considered non-responsive.
