Consent of landowner. ‌ 6.1 In the event that You are not the owner of all or part of the land where the Project will be constructed, installed or otherwise delivered, You: (a) warrant that You have obtained the approval and agreement of the landowner to construct, install or otherwise deliver the Project on their land; and (b) indemnify and agree to keep indemnified the Department, the Crown in right of the State of New South Wales and their officers, employees and agents from and against any cost, expense, loss (including legal costs and expenses on a solicitor/own client basis) or liability incurred or suffered by, or made against, any of those indemnified arising directly or indirectly from any Claim by the land owner or interested third party as a result of or in connection with the Project.
