Common use of Consequence of Employee’s Breach Clause in Contracts

Consequence of Employee’s Breach. Employee acknowledges and agrees that if Employee breaches any obligation under this Agreement, Masco may immediately terminate any remaining payments and the provision of any other benefits that might otherwise be required by this Agreement. Any such termination by Masco shall not impair the validity or enforceability of the release provision of this Agreement.

Consequence of Employee’s Breach. Employee acknowledges and agrees that if Employee Employee, in Masco’s good faith judgment, breaches any obligation under this Agreement or the Retention Agreement, Masco may immediately terminate any remaining payments and the provision of any other benefits that might otherwise be required by this Agreement; provided, however, Employee will be paid or allowed to retain $1,000 of the Retention Incentives. Any such termination by Masco shall not impair the validity or enforceability of the release provision of this Agreement.
