Common use of Consequence of Step-In Clause in Contracts

Consequence of Step-In. If Council elects to exercise the step-in rights granted to it under clause 7.3 then: (1) Council may: (a) only enter upon parts of the Land that it requires access to in order to satisfy the obligations of the Developer in accordance with the Defects Notice; and (b) rectify the relevant Defects in accordance with the Defects Notice; and (2) the Developer must not impede or interfere with Council in undertaking that work.
