Consequential or Other Damages. In no event will TRINITY or any of its trustees, officers, employees, agents, and volunteers be liable to the CONSULTANT or any other person or entity for payment of any consequential, incidental, punitive or other special damages arising from a failure to perform its obligations under this Agreement, including but not limited to lost profits.
