Common use of Consolidated Senior Debt to Capitalization Ratio Clause in Contracts

Consolidated Senior Debt to Capitalization Ratio. the Consolidated Senior Debt to Capitalization Ratio shall not at any time exceed 50%, provided that if the Borrower, the Trust or a Designated Subsidiary completes a Material Acquisition (and provided that the Borrower would have continued to comply with this Section 8.3(c) if such Material Acquisition had not been made and provides a calculation evidencing such compliance in its Compliance Certificate relating to such Fiscal Quarter), then during the period from the completion of such Material Acquisition to the end of the second complete Fiscal Quarter after completion of such Material Acquisition, the Borrower may permit the Consolidated Senior Debt to Capitalization Ratio to increase to a level not exceeding 55%; and
