CONSTRUCTION AND OTHER PROVISIONS. (a) Wherever appropriate in this Agreement, the singular shall be deemed to refer to the plural and the plural to the singular, and pronouns of each gender shall be deemed to comprehend either or both of the other genders. As used in this Agreement, the terms “herein”, “hereof” and the like refer to this Agreement in its entirety and not to any specific section or subsection. (b) If any provisions of this Agreement or any escrow instructions signed pursuant to this Agreement are held by a court of competent jurisdiction to be invalid, this determination shall not affect the validity of the remaining provisions of this Agreement. (c) The waiver by one party of the performance of any agreement, condition, or obligation under this Agreement shall not invalidate this Agreement nor shall it be considered a waiver by that party of any other agreement, condition, or obligation under this Agreement. The waiver by either or both parties of the time for performing any act required by this Agreement shall not constitute a waiver of the time for performing any other act required to be performed at a later time.
