All warranties and representations made by the Contractor and its subcontractors in the Contract and the Contractor’s Response, whether or not the Contract specifically denominates warranties and representations as a warranty or whether the warranty is created only by the Contractor’s affirmation or promise, or is created by a description of the Services to be provided, or by provision of samples to the State shall not be construed as limiting or negating any warranty provided by law, including without limitation, warranties which arise through course of dealing or usage of trade, the warranty of merchantability, and the warranty of fitness for a particular purpose.
