Construction Start Date. Licensee shall start construction of the System after receipt of Trustees’ Notice to Proceed. Licensee shall provide written notice to Trustees of the date that Licensee commences construction at the Site (the “Construction Start Date”) and shall diligently pursue construction until the System’s completion. If Licensee has not commenced substantial construction activities by [Month, day, year], either Party may terminate this Agreement by written notice to the other Party. In the event of such notice by either Party, this Agreement shall terminate, Trustees shall retain any Transaction Fee paid or due as of the date of such termination notice, Licensee shall comply with Section 13.1 and neither Party shall have any further obligation to the other Party.
Construction Start Date. The Construction Start Date shall occur no later than three hundred and sixty (360) days after the Effective Date of this Agreement, provided that the Construction Start Date may be extended on a day-for-day basis for not more than one hundred and eighty (180) days: if Seller has used commercially reasonable efforts (including but not limited to Seller’s timely filing of required documents and payment of all applicable fees) to obtain permits necessary for the construction and operation of the Facility, but is unable to obtain such permits due to delays beyond Seller’s reasonable control (“Permitting Delay”); if Seller has used commercially reasonable efforts (including but not limited to Seller’s timely filing of required documents and payment of all applicable fees) to have the Facility physically interconnected to the PG&E system or CAISO Grid and to complete all electric system upgrades needed, if any, in order to interconnect the Facility to the PG&E system or CAISO Grid, but fails to secure any necessary commitments from CAISO or PG&E for such interconnection and upgrades due to delays beyond Seller’s reasonable control (“Transmission Delay”); or, in the event of Force Majeure without regard to Transmission Delay or Permitting Delay provided that Seller works diligently to resolve the effect of the Force Majeure and provides evidence of its efforts promptly to Buyer upon Buyer’s written request. Guaranteed Commercial Operation Date Seller shall demonstrate Commercial Operation no later than five hundred and forty (540) days after the Effective Date of this Agreement (the “Guaranteed Commercial Operation Date”), provided that the Guaranteed Commercial Operation Date may be extended on a day-for-day basis for (a) any extension claimed by Seller pursuant to and in accordance with Section 5.3, and (b) Force Majeure occurring after the Construction Start Date, provided that the total number of such further extension days under this subpart (b) shall not exceed one hundred and eighty (180) days.

Licensee shall provide written notice to the Judicial Council of the date that Licensee commences construction at the Site (the “Construction Start Date”) and shall diligently pursue construction until the System’s completion. If Licensee has not commenced substantial construction activities within sixty (60) calendar days after Licensee’s receipt of the Notice to Proceed, either Party may terminate this SLA by written notice to the other Party. In the event of such notice by either Party, this SLA shall terminate, the Judicial Council shall retain any Transaction Fee paid or due as of the date of such termination notice, Licensee shall comply with section 11.1 and neither Party shall have any further obligation to the other Party.

LICENSEE shall provide written notice to the DGS of the date that LICENSEE commences construction at the Site (the "Construction Start Date") and shall diligently pursue construction until the System’s completion. If LICENSEE has not commenced substantial construction activities within sixty (60) calendar days after LICENSEE’s receipt of the Notice to Proceed, either Party may terminate this SLA by written notice to the other Party. In the event of such notice by either Party, this SLA shall terminate, the DGS shall retain any Transaction Fee paid or due as of the date of such termination notice, LICENSEE shall comply with Section 11.1 and neither Party shall have any further obligation to the other Party.
Construction Start Date. Seller shall provide Buyer with a written certification substantially in the form set forth in Appendix III within ten (10) Business Days of delivering a Notice to Proceed to the EPC Contractor for the Project.
Construction Start Date. A. Absolutely no work on this project may commence until all of the following conditions have been met:

The Developer reserves the right to commence construction of the Improvements any time after recording of the final plat, if weather conditions permit, and the obtaining of the financial security guarantee set forth herein. The Developer will be solely and fully responsible for the supervision of subcontractors and timely completion of installation of the Improvements detailed in Exhibit B and the recorded plat.
Construction Start Date. The date construction of the Improvements ----------------------- begins, which shall be the date the excavation for the Improvements commences, but in no event later than June 1, 1999, which date is subject to extension due to Force Majeure (as defined herein) but in no event to extend beyond three months from the applicable date set forth above in this paragraph.
