Construction Supervision. 3.6.2.1 Commencing with the award of the first subcontract and terminating on the date of Final Completion, the Construction Manager shall provide the services described herein.
3.6.2.2 The Construction Manager shall, as the Owner's construction representative during construction, advise and consult with the Owner and the Professional, and provide administration of the Construction Documents.
3.6.2.3 The Construction Manager shall supervise and direct the Work at the Site. The Construction Manager shall, at a minimum, staff the Project Site with personnel who shall:
(i) supervise and coordinate the Construction Manager's personnel and act as its primary liaison with the Owner and the Professional;
(ii) coordinate trade contractors and suppliers, and supervise Site construction management services;
(iii) be familiar with all trade divisions and trade contractors’ scopes of Work, all applicable building codes and standards, and the Contract for Construction;
(iv) check, review, coordinate and distribute shop drawings and check and review materials delivered to the Site, regularly review the Work to determine its compliance with the Construction Documents and the Contract for Construction, confer with the appropriate Owner's consultant(s) as necessary to assure acceptable levels of quality;
(v) prepare and maintain Project records, including process documents and daily logs;
(vi) schedule and conduct weekly progress meetings with subcontractors to review such matters as jobsite safety, job procedures, construction progress, schedule, shop drawing status and other information as necessary and provide notification of, and minutes from, such meetings to Owner and Professional;
(vii) schedule and conduct weekly progress meetings with the Owner and Professional to review such matters as construction progress, schedule, shop drawing status, and other information as necessary;
(viii) make provision for Project security to protect the Project site and materials stored off-site against theft, vandalism, fire and accidents as required by the General Terms and Conditions.
(ix) promptly reject any Work which does not conform to the Construction Documents or which does not comply with any applicable law, statute, building code, rule or regulation of any public authority or agency of which it is aware, immediately notifying the Professional and the Owner in writing when it has rejected any Work;

Construction Supervision. The Contractor shall be solely responsible to supervise and direct the Work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with the Contract. The Contractor shall be solely responsible for the means, methods, techniques, sequences, and procedures of construction. The Contractor is solely responsible to the City that the finished Work complies with the Contract Documents. The Contractor shall be solely responsible for health and safety precautions and programs for workers and others in connection with the Work. No inspection by, knowledge on the part of, or acquiescence by the City, or any other entity whatever shall relieve the Contractor from its sole responsibility for compliance with the requirements of the Contract or responsibility for health and safety programs and precautions.
Construction Supervision. The A/E shall not be responsible for construction means, methods, techniques, sequences, procedures, supervision or for safety precautions and programs in conjunction with the project or work thereon.
Construction Supervision. (a) The Owner shall give to the Facility Agent and the Technical Adviser notice of any meetings of the Owner or the Owner’s representatives with the Builder or between the Owner or the Owner’s representatives and any Charterer or the Charterer’s representatives where material divergence from the Specification (as defined in the Shipbuilding Contract) is being discussed. Following any such meeting, the Owner shall notify the Facility Agent and the Technical Adviser of the outcome of such meeting. Such advance notice and notice of the outcome shall be contained in the quarterly technical reports referred to in Clause 15.3(d).
(b) The Owner shall make reasonable efforts to obtain the Builder’s consent so that the Facility Agent (at the Facility Agent’s own risk and expense) or its representative has a right to attend, in a capacity as an observer only, the shipyard on an occasional basis and to be present at the sea trials and first drill trial of the Vessel.
(c) The Owner will give reasonable notice to the Facility Agent of the time and location of any of the meetings, trials and voyages referred to in paragraph (b) above.
Construction Supervision. 6.4.1 Unless waived by the Contracting Authority in writing, the CM shall provide continuous supervision at the Site by a competent superintendent when any Work is being performed, and the CM’s superintendent shall not be involved with any work other than the Project.
6.4.2 The CM’s project manager and superintendent shall each have the responsibility and authority to act on behalf of the CM. All communications to the CM’s project manager or superintendent shall be binding as if given directly to the CM.
6.4.3 For all Subcontracts in excess of $200,000, the CM shall submit an outline of the qualifications and experience of the Subcontractor’s proposed project manager and proposed superintendent, including references, to the Contracting Authority no less than ten days before the Subcontractor is scheduled to begin Work on the Site. For all other Subcontracts, upon receiving a request from the Contracting Authority, the CM shall submit an outline of the qualifications and experience of the Subcontractor’s proposed project manager and proposed superintendent, including references, to the Contracting Authority.
6.4.3.1 The Contracting Authority may reject the Subcontractor’s proposed project manager or proposed superintendent. If the Contracting Authority does not notify the CM of the rejection within 30 days after receiving the required information, it shall indicate that the Contracting Authority has no objection, but does not affect the Contracting Authority’s rights under Section 6.10.2 or any other provision relative to that project manager or superintendent.
6.4.3.2 If the Contracting Authority rejects the Subcontractor’s proposed project manager or proposed superintendent, the CM shall cause the Subcontractor to replace the project manager or superintendent (as appropriate) with someone acceptable to the Contracting Authority at no additional cost.
6.4.4 The CM and its Subcontractors shall not replace their respective project managers or superintendents without prior written approval of the Contracting Authority.
6.4.4.1 If the CM or a Subcontractor proposes to change its project manager or superintendent, the CM shall submit written justification to the Contracting Authority, along with the name and qualifications of the proposed replacement.
6.4.4.2 The procedure provided in Section 6.4.3 shall be conducted to evaluate the CM or Subcontractor’s (as applicable) proposed replacement project manager or superintendent.

(i) Supervise and coordinate the Construction Manager's personnel and act as its primary liaison with the Owner and the Owner's Consultant(s);
(ii) Coordinate trade contractors and suppliers, and supervise Site construction management services;
(iii) Be familiar with all trade divisions and trade contractors’ scopes of Work, all applicable building codes, the Construction Documents, and this Contract for Construction Management;
(iv) Check and review shop drawings and materials delivered to the Site, regularly review the Work to determine its compliance with the Construction Documents and this Contract for Construction Management, and forward those documents to, and periodically confer with, the appropriate Owner's consultant(s) to assure acceptable levels of quality; and
(v) Prepare and maintain Project records, process documents, and staff the Site field office.
3.2.4 The Construction Manager shall promptly reject any Work which does not conform to the Construction Documents or which it observes and understands does not to comply with any applicable law, statute, building code, rule or regulation of any public authority or agency of which it is aware. The Construction Manager shall immediately notify the Professional(s) and the Owner in writing when it has rejected any Work.
3.2.5 The Construction Manager shall comply with and cause its subcontractors and suppliers to comply with the Project Construction Schedule and applicable sub- schedules. The Construction Manager shall obtain and review schedules from subcontractors and suppliers, coordinate sub-schedules with the Construction Schedule, and enforce compliance with the all applicable schedules to insure timely completion of the Work. Construction Supervision a) The Construction Manager shall establish sufficient on-site organization, staffing and support as well as clear lines of authority in order to expeditiously complete the Project in accordance with the Contract Documents, in every aspect, on a totally coordinated basis.
b) The Construction Manager shall maintain a competent full-time staff at the site to supervise, schedule and coordinate the Work of all Trade Contractors in accordance with the University's objectives including cost, time for completion and quality of the Work. The Construction Manager’s Staff shall include the team members identified in the Construction Manager’s proposal dated [DATE] (the “Key Team Members”). Construction Manager agrees to assign the above listed Key Team Members to the Project. Construction Manager shall promptly notify the University if services of any one of the listed Key Team Members become unavailable due to circumstances beyond the Construction Manager’s control – e.g., extended illness or disability, death, or termination of employment, etc. The University shall have the right to interview and select alternate team member(s) employed by the Construction Manager to replace the unavailable team member. Construction Manager shall agree to provide the services of the alternate team member(s) selected by the University. Construction Manager is not entitled to additional compensation for any such substitution(s) of the project team members. In addition to any other remedy by the University, the University may require Construction Manager to surrender ten percent (10%) of Construction Manager’s Overhead and Profit for each replaced Key Team Member.
c) The Construction Manager shall conduct preconstruction conferences with Trade Contractors and schedule and conduct regular progress meetings to be attended by all parties in interest to discuss such matters as procedures, progress, job problems, scheduling, changes, and related matters.
d) The Construction Manager shall take, transcribe and promptly distribute to all parties, including the University, minutes of such progress meetings with the Trade Contractors, weekly job meetings and monthly management meetings.
e) The Construction Manager shall maintain an on-site daily log of construction progress, problems and items of special interest. Construction Supervision. Owner and Manager may agree that Manager shall act as construction supervisor with respect to any construction work for the Facility or on the Real Property after the Commencement Date (as defined in Paragraph 1), in which event Manager will supervise, oversee and administer each and every aspect of any such improvements and construction work. For the purposes of this Agreement, "construction work" shall include any construction, reconstruction or alteration of any improvements constituting part of the Real Property, but shall not include usual maintenance and repairs made to the Facility or the Real Property. Without limitation of the foregoing, if Owner and Manager agree that Manager shall act as construction supervisor, and subject to Owner's approval in each instance, Manager will: (a) negotiate contracts for architectural, design, engineering and construction services; (b) secure any and all necessary consents and approvals; (c) oversee the administration of construction contracts; and (d) act as project manager with respect to the construction work.
Construction Supervision. During the course of the installation work, Licensee, or Licensee’s contractors or designees, will have a qualified construction supervisor onsite with whom Trustees can communicate with respect to the Installation Work. If, in the reasonable judgment of Trustees, such construction supervisor is incompetent, unqualified, poorly performing, or disorderly, Licensee shall, upon request by Trustees, promptly replace such construction supervisor with an individual reasonably acceptable to Trustees.
