Common use of Construction Traffic Clause in Contracts

Construction Traffic. 12.6.1 The Company shall use every reasonable means to prevent any of the roads, accesses or bridges communicating with or on the routes to the New Works Site from being subjected to extraordinary traffic within the meaning of Section 96 of the Roads (Scotland) Act 1984 by any traffic of the Company and in particular shall select routes and use vehicles and restrict and distribute loads so that any such extraordinary traffic as shall arise from the moving of Constructional Plant and material or manufactured or fabricated articles from and to the New Works Site shall be limited as far as reasonably possible and so that no unnecessary damage or injury may be occasioned to such roads and bridges. 12.6.2 Save insofar as this Agreement otherwise provides the Company shall be responsible for and shall pay the costs of strengthening any bridges or altering or improving any road communicating with the New Works Site to facilitate the movement of Constructional Plant, equipment or temporary New Works or other items or vehicles required in the execution of the New Works and the Company shall negotiate and pay all claims arising out of any damage to any roads or bridges caused by such movement without recourse to the Contracting Authority.
