Common use of Consultant’s Report Clause in Contracts

Consultant’s Report. A report from the Construction Consultant to the effect that (i) it has received and approved the items required by paragraph (f) below, (ii) the Plans and Specifications have been approved by all applicable Governmental Authorities, (iii) the Improvements as shown by the Plans and Specifications will comply with applicable zoning and other Laws, (iv) a Construction Management Agreement and/or Trade Contracts are in effect which satisfactorily provide for the construction of the Improvements, subject, however, to the provisions of Section 4.01(e)(19) regarding signed Trade Contracts, (v) all roads and utilities necessary for the full utilization of the Improvements for their intended purposes have been completed, or the presently installed and proposed roads and utilities will be sufficient for the full utilization of the Improvements for their intended purpose and will be available to and servicing the Premises upon completion of the Improvements, (vi) the construction of the Improvements theretofore performed, if any, was performed in accordance with the Plans and Specifications and (vii) construction of the Improvements, along with all necessary roads and utilities, will be finished on or before the Completion Date; and to such other effects as Administrative Agent may reasonably request;

Consultant’s Report. A report from the Construction ------------------- Consultant to the effect effects that (i) it has received and approved the items required by paragraph (fb) below, (ii) the Plans and Specifications referred in paragraph (15) above have been approved by all applicable Governmental Authorities, (iii) the Improvements as shown by the said Plans and Specifications will comply with applicable zoning and other Laws, including requirements for parking spaces, (iv) a Construction Management Agreement and/or Trade Contracts General Contract and Major Subcontracts are in effect which satisfactorily provide for the construction of the ImprovementsBuildings 3, subject4, however6, to the provisions of Section 4.01(e)(19) regarding signed Trade Contracts7 and 8, (v) all roads and utilities necessary for the full utilization of the Improvements for their intended purposes have been completed, or the presently installed and proposed roads and utilities will be sufficient for the full utilization of the Improvements for their intended purpose and will be available to and servicing the Premises upon completion of the Improvements, (vi) the construction of the Improvements theretofore performed, if any, was performed in accordance with the Plans and Specifications and (vii) construction of the Improvements, along with all necessary roads and utilities, will be finished on or before the Completion Date; and to such other effects as Administrative Agent may reasonably request;

A report from the Construction Consultant to the effect that (i) it has received and approved reviewed the construction related items required by paragraph the Disbursement Agreement and certifications from the professionals of record asserting that (f) below, (iia) the Plans and Specifications have been approved by all applicable Governmental Authorities, (iiib) the Improvements as shown by the Plans and Specifications will comply with applicable zoning and other LawsLaws in all material respects, (ivc) a Construction Management Agreement and/or Trade Contracts are in effect which satisfactorily provide for the construction of the Improvements, subject, however, to the provisions of Section 4.01(e)(19) regarding signed Trade Contracts, (v) all roads and utilities necessary for the full utilization of the Improvements for their intended purposes have been completed, or the presently installed and proposed roads and utilities will be sufficient for the full utilization of the Improvements for their intended purpose and will be available to and servicing the Premises Project Site upon completion of the Improvements, (vid) the construction of the Improvements theretofore performed, if any, was heretofore performed were performed in accordance with the Plans and Specifications in all material respects and (viiii) major subcontracts are in effect which satisfactorily provide for the construction of the Improvements and (iii) construction of the Improvements, along with all necessary roads and utilities, will are expected to be finished on or before the Scheduled Completion Date; and to such other effects as Administrative Agent may reasonably request;

A report from the Construction Consultant to the effect effects that (i) it has received and approved the items required by paragraph (fe) below, (ii) the Plans and Specifications have been approved by all applicable Governmental Authorities, (iii) the Improvements as shown by the Plans and Specifications will comply with applicable zoning and other LawsLaws and with all applicable Premises Documents, (iv) a Construction Management Agreement General Contract and/or Trade Contracts Major Subcontracts are in effect which satisfactorily provide for the construction of the Improvements, subject, however, to the provisions of Section 4.01(e)(19) regarding signed Trade Contracts, (v) all roads and utilities necessary for the full utilization of the Improvements for their intended purposes have been completed, or the presently installed and proposed roads and utilities will be sufficient for the full utilization of the Improvements for their intended purpose and will be available to and servicing the Premises upon completion of the Improvements, (vi) the construction of the Improvements theretofore performed, if any, was performed in accordance with the Plans and Specifications and (vii) construction of the Improvements, along with all necessary roads and utilities, will be finished on or before the Completion Date; and to such other effects as Administrative Agent may reasonably request;
