Common use of Consultant’s Standard of Care Clause in Contracts

Consultant’s Standard of Care. Subject to the other provisions of this Agreement, CONSULTANT shall provide the Consultant Services with the same degree of diligence, care, skill and prudence that would be customarily exercised by an executive officer of a U.S. public company and in the best interest of the COMPANY.

Subject to the other provisions of this Agreement, CONSULTANT shall provide the Consultant Services with the same degree of diligence, care, skill and prudence that would be customarily exercised by an executive officer the general counsel of a U.S. public company whose shares are listed on the New York Stock Exchange and in the best interest of the COMPANY.
