Consumer Privacy. The agreement must require each state to adopt a uniform policy for certified service providers that protects the privacy of consumers and maintains the confidentiality of tax information.
Consumer Privacy. Client and DST shall comply with all applicable laws, rules and regulations relating to privacy, confidentiality, security, data security and the handling of personal financial information applicable to it that may be established from time to time, including but not limited to the Xxxxx-Xxxxx-Xxxxxx Act and Securities and Exchange Commission Regulation S-P (17 CFR Part 248) promulgated thereunder and the Massachusetts Standards for the Protection of Personal Information 201 CMR 17.00, et. seq.
Consumer Privacy. Customer and SS&C shall each comply with applicable U.S. laws, rules and regulations relating to privacy, confidentiality, security, data security and the handling of personal financial information applicable to it that may be established from time to time, including but not limited to the Xxxxx-Xxxxx-Xxxxxx Act and Securities and Exchange Commission Regulation S-P (17 CFR Part 248) promulgated thereunder.
Consumer Privacy a.) In connection with this Agreement, the Company will cause the Agent to be provided Information, which will include nonpublic personal data regarding customers and bank account records. Unless required by law or unless prior written consent is obtained from the Company, the Agent will not knowingly disclose any such nonpublic personal data except to persons described in Section 3 a.), in connection with performing the Services.
b.) The Agent (or its agents) has implemented and will maintain physical, electronic and procedural safeguards reasonably designed to protect the security, confidentiality and integrity of, to prevent unauthorized access to or use of, and to ensure the proper disposal, of nonpublic personal data regarding customers and bank accounts records. Notwithstanding the foregoing, given the nature of electronic communications and the Internet, the Agent makes no absolute guarantees regarding the safety and security of any data transmitted over or accessible via the Internet or any other public networks.
c.) Upon consummation of the Stock Offering, termination of this Agreement or other reasonable time, at the written request of the Company, and at its sole expense, the Agent shall use its reasonable efforts to transfer to the Company or destroy all physical or electronic Confidential Information, including nonpublic personal data regarding customers and bank account records (excluding data, software and documentation proprietary to the Agent (or its agents)) and shall not retain copies of such data and documentation; provided however, that the Agent (and its agents) may retain copies to the extent necessary, but only for as long as necessary, to comply with legal, regulatory and archival requirements.

The parties acknowledge that the Title Linked Services, while comprised in part of public record data, describes information that may be deemed to be sensitive information by some consumers. It is the policy of First American Title to respect the request of consumers to remove their name, mailing address or telephone number from use in solicitation. First American Title understands and agrees that such information provided to First American Title by the End-User is encrypted and that Ellie Mae does not have access to such information through the End-User’s use of the Ellie Mae Platform without otherwise obtaining the consumer’s consent. This policy is an integral condition to First American Title entering into this Agreement. Both parties agree that: (a) they will not utilize in any manner the name, mailing address or telephone number of a consumer that is designated within any Title Linked Service as requesting protection from solicitation; (b) they will not broadcast or otherwise make public the name, address or other information about an individual consumer, unless First American Title and the subject consumer provide written authorization to do so; (c) they will abide by all prevailing federal, state, and local guidelines governing information practices and consumers’ rights to privacy; and (d) they will limit access to consumer information to those individuals who have a “need to know” in connection with their respective businesses and will obligate those individuals to acknowledge consumers’ rights to privacy and adhere to fair information practices. The parties will adopt, publish, and comply with privacy policies that comply with the guidelines established by the International Computer Standards Association and by either the guidelines established by XXXXXx.xxx as more fully set forth at xxxx://xxx.xxxxxx.xxx, the Better Business Bureau, or such other organizations as the parties mutually agree to select. The parties agree to comply with the applicable requirements under the Xxxxx-Xxxxx-Xxxxxx Act (15 U.S.C. 6801 et seq.) and the Privacy Safeguards Rule promulgated by the Federal Trade Commission thereunder (16 C.F.R. 314) (together, “GLB Act”) with respect to “nonpublic information” (as defined under the GLB Act) they receive from consumers, including, without limitation, to use that information solely for the purposes of carrying out this Agreement and implementing procedures required under the GLB Act to safeguard such information.

Customer acknowledges that the Service, while comprised in part of data keyed in by the Customer, describes information that may be deemed to be sensitive information by some consumers. It is the policy of Provider to respect the request of consumers to remove their name, mailing address, e-mail address or telephone number from use in solicitation. Customer’s agreement to comply with this policy is an integral condition to Provider entering into this Agreement.
Consumer Privacy. Nothing in this Agreement shall be deemed to require either party to take any action that would cause either of Bank or the Company to violate applicable consumer privacy law, including Title V of the Xxxxx-Xxxxx-Xxxxxx Act and the Fair Credit Reporting Act.
Consumer Privacy. Subscriber agrees to comply with all applicable consumer privacy and information security laws. The MLS Compilation or other information provided through the BCBR Services may contain personally identifiable information about consumers, BCBR Subscribers, or other third-parties. Subscriber acknowledges it is only permitted to use such personally identifiable information for purposes authorized by this Agreement or the Rules and is prohibited from using any personally identifiable information for any other purpose, including without limitation any advertising or other commercial use, and shall not disclose personally identifiable information to any third-party.
Consumer Privacy. Customer acknowledges that the Service, while comprised in part of public record data, describes information that may be deemed to be sensitive information by some consumers. It is the policy of FARES to respect the request of consumers to remove their name, mailing address or telephone number from use in solicitation. Customer’s agreement to comply with this policy is an integral condition to FARES entering into this Agreement. Customer agrees (a) Customer will not utilize in any manner the name, mailing address or telephone number of a consumer that is designated in the Service as requesting protection from solicitation; (b) Customer will abide by all prevailing federal, state, and local guidelines governing fair information practices and consumers’ rights to privacy; and (c) Customer will limit access to consumer information to those individuals who have a “need to know” in connection with Customer’s business and will obligate those individuals to acknowledge consumers’ rights to privacy and adhere to fair information practices.
