Consumer Products. WITH RESPECT TO “CONSUMER PRODUCTS” AS DEFINED UNDER THE XXXXXXXX-XXXX WARRANTY ACT (“MMWA”), THE FOLLOWING STATEMENTS ARE MADE. (A) SOME STATES OR LOCAL LAWS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU; (B) IF ANY IMPLIED WARRANTY IS PROVIDED UNDER THE MMWA, IT IS LIMITED TO THE DURATION OF THE WARRANTY PROVIDED IN SECTION 18 ABOVE. (C) SOME STATES OR LOCAL LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU; AND (D) THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE OR LOCATION TO LOCATION.
Consumer Products. Devices, products, articles or merchandise of common or frequent use, ordinarily bought by individuals or households for private consumption from a retail outlet or otherwise obtained or provided direct to the consumer. Consumer Products expressly includes Xxxxxxxx-Xxxxx Consumer Products. Consumer Products do not include products, articles or merchandise sold by Xxxxxxxx-Xxxxx’x Global Health Care Business as of the Effective Date of this Agreement.
Consumer Products. Jointly Developed Projects for the consumer audience may include NDC's prescription adherence/compliance tool called Care Alert, which the Parties acknowledge will initially target consumers and the prescription refill market. If the Parties mutually agree, Care Alert may also target the physicians market by leveraging other NDC and Medscape tools and services. The Parties further acknowledge that the consumer-based Care Alert product is currently in prototype and is expected to launch in the third quarter of 1999.
Consumer Products. With respect to “consumer products” as defined under the Xxxxxxxx-Xxxx Warranty Act (“MMWA”), the following statements are made.
(a) Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. IF ANY IMPLIED WARRANTY IS PROVIDED UNDER THE MMWA, IT IS LIMITED
Consumer Products. 15.10.1 Where Licensee has:
(a) paid for a Product; or
(b) received a Product for free as part of a bundle with other paid goods, services or other digital content, and this Product is not generally available to Consumers unless they have paid a price for it or for the other goods, services or other digital content, Sophos warrants that such Products will be (i) of satisfactory quality, (ii) reasonably fit for purpose, and (iii) as described in the Documentation.
Consumer Products. (a) Notwithstanding anything to the contrary in this Agreement or in any other JV Agreement, each of the Solazyme Group and the Bunge Group may research, develop, market and sell, directly or indirectly, consumer products derived from Products. Notwithstanding the foregoing, Solazyme shall not launch a consumer product derived from a Product in a Bunge B2C Field in the associated Bunge B2C Jurisdictions if, in the reasonable, judgment of BGI, the Solazyme consumer product will compete with the Bunge consumer product within the targeted sub segment of the Solazyme consumer product, within the same product line. For example, a premium bottled oil aimed at a high value sub segment of bottled oils shall not be deemed to compete with a commodity bottled oil aimed at a mid or low value sub segment of bottled oils.
(b) The Solazyme Group and the Bunge Group will make reasonable efforts to launch consumer products derived from Products in fields and markets that are complementary to the then existing fields and markets in which each group is conducting, or plans to do conduct, such business.
Consumer Products. For purposes of this Agreement, "Consumer Products" shall mean, without limitation, Olympus brand silver halide cameras, digital cameras, binocular products, microcassette recorders and transcribers, optical storage devices, computer peripheral products and other Olympus brand consumer products manufactured by or for Buyer and distributed by Seller pursuant to the Distribution Agreement between Buyer and Seller dated April 1, 1994, as amended (the "Distribution Agreement"); and Olympus brand related accessories, consumables and supplies manufactured by or for Buyer.

PRODUCTS Corded and cordless telephones, cellular phones, . answering systems and telephone accessories, including intercoms, fax line adapters, modular headsets, specialty products and tone/xxxx ringers. Communications systems for disabled persons. VideoPhones. Smart Cards. Personal communicators. Personal computers, copiers and printers of third party vendors.
B. CUSTOMERS/MARKETS Consumers. Small businesses that acquire the products through AT&T Phone Center stores.
