Consumer Rights. Care has been taken to use plain language and to give clear explanations in these terms and conditions. If any words alone or in combination infringe consumer rights laws or any other provision of law, they shall be treated as severable and shall be replaced with words which give as near the original meaning as may be fair. Nothing in these terms and conditions affects the Parents' statutory rights.

This includes: Discrimination – Human Rights Commission (RCW 49.60); 42 CFR 438.214, Title VI of the Civil Rights Act of 1964 as implemented by regulations at 45 CFR part 80; the Age Discrimination Act of 1975 as implemented by regulations at 45 CFR part 91; the Rehabilitation Act of 1973; titles II and III of the Americans with Disabilities Act; and other laws regarding privacy and confidentiality. The Contractor shall ensure that its staff takes these rights into account when furnishing services to consumers.

If you are a consumer: (a) statutory warranties provided in the Law No. 8.078/1990 (“Consumer Protection Code”) apply to you despite anything to the contrary in Section 11.1 (Disclaimers); (b) Section 11.2 (Exclusion of Certain Liability) will not apply to you in relation to the damages caused to you due to defects in the Services, as provided by Article 14 of Law No.
Consumer Rights. Nothing in this Agreement affects any statutory rights of consumers that cannot be waived or limited by contract. You may have additional consumer rights under applicable local laws, which this Agreement cannot change.

a) Hire Independent Providers of their choice, with full disclosure of relevant information on registry referrals;
b) Remove providers from their service at will and without appeal;
c) Determine in advance and under all circumstances who may or may not enter their homes;
d) Manage, supervise, and direct the Independent Providers assisting them.

Nothing in this Agreement will reduce your statutory rights relating to the provision of educational services. For further information about your statutory rights you should contact your local Citizens Advice Bureau or otherwise seek appropriate professional advice.
Consumer Rights a. The Union and the Public Authority recognize the right of consumers, as established by law and by the Ordinance creating this Public Authority, to hire, terminate and supervise the work of any IHSS Provider providing services to them, as well as to train such individuals in the manner in which those services are to be provided.
b. The Union shall neither seek nor receive information from the Public Authority regarding the name, address, phone number, or any other personal information regarding consumers. Union representatives and IHSS Providers shall maintain strict standards of confidentiality regarding consumers and shall not disclose personal information pertaining to consumers obtained from any source unless the disclosure is compelled by the legal process or otherwise required by law. The consumer may consent to limited disclosure of information described herein and such consent may be withdrawn at any time for any reason.
Consumer Rights. Nothing in this agreement is intended to limit the rights of a consumer, as may be defined by applicable law. To the extent necessary, this agreement is considered to be modified to reflect this intention. Consumers may have the benefit of certain rights of remedies which may not be excluded under applicable law. If so and to the maximum extent permitted by law, our liability is limited, at our option either to (a) re-supply the services, or (b) the cost to re-supply the services.
