Contamination caused by Developer. If Contamination in, on or under the Land or land which is outside the boundary of the Land is caused by the Developer or as a direct consequence of the Works being undertaken or carried out by the Developer under this Agreement, the Developer will, at its own cost, remediate the Contamination.

Contamination caused by Developer. (a) If Contamination in, on or under the Land or land which is outside the boundary of the Land is caused or contributed to by the Developer or as a direct consequence of the Works being undertaken or carried out by the Developer under this Agreement, the Developer will, at its own cost and within a reasonable time, remediate (to the extent that such Contamination is caused or contributed by the Developer) the Contamination to a standard suitable for the current and proposed future use of that land known at the time of remediation. (b) Where Contamination is caused or contributed to by the Developer as a direct consequence of the Works being undertaken or carried out by the Developer under this Agreement, and that Contamination is in, on or under any land that is owned or occupied by the Council, or under the management and control of the Council, the Developer indemnifies and must keep indemnified Council against all liability for and associated with all such Contamination.
