Common use of Contents of the Initial Notice Clause in Contracts

Contents of the Initial Notice. Design-Builder shall not be entitled to any adjustment in the Contract Sum for any occurrence of events or costs that occurred more than fourteen (14) days before Design-Builder’s written notice to Owner. The written notice shall set forth, at a minimum, a description of: (a) the event giving rise to the request for an equitable adjustment in the Contract Sum; (b) the nature of the impacts to Design-Builder; and (c) to the extent possible the amount of the adjustment in Contract Sum requested. Failure properly to give such written notice shall constitute a waiver of Design-Builder’s right to an equitable adjustment.
