CONTESTED TERMINATION. If a party shall give notice of termination of this Agreement pursuant to Section 6.3 and the other party shall, within five days of receipt of such notice, commence legal proceedings contesting the terminating party's right to so terminate this Agreement, the parties shall continue to perform under this Agreement until the resolution of such controversy.
CONTESTED TERMINATION. If Sponsor contests termination of the Project Agreement, Sponsor shall make commercially reasonable efforts to avoid termination and enforce its rights under the Project Agreement, including commencing an action for wrongful termination if deemed appropriate by Sponsor. In the event that a court renders a final, non-appealable judgment finding that Developer appropriately terminated the Project Agreement for Sponsor Event of Default, Sponsor shall be responsible for making an Alternate Economic Investment in accordance with Section 5.02(f).
