Common use of Contingency of Funds Clause in Contracts

Contingency of Funds. PROVIDER acknowledges that funding of the Agreement is contingent upon appropriation and availability of funds by the California State Department of Education. If such funding or appropriations are not forthcoming, or are otherwise limited, SCOE shall immediately notify PROVIDER in writing. PROVIDER shall modify or cease operations as directed by SCOE within fourteen (14) days of receipt of such written notice.
