Continuing Performance. In the event of a dispute, the Owner and the Developer agree to continue their respective performance hereunder to the extent feasible in light of the dispute, including paying xxxxxxxx, and such continuation of efforts and payment of xxxxxxxx shall not be construed as a waiver of any legal right.
Continuing Performance. (a) The obligations under this Agreement continue until satisfied in full and do not merge with any action performed or document executed by any Party for the purposes of performance of this Agreement.
(b) Any representation in this Agreement survives the execution of any document for the purposes of, and continues after, performance of this Agreement.
(c) Any indemnity given by any Party under this Agreement:
(i) constitutes a liability of that Party separate and independent from any other liability of that Party under this Agreement or any other agreement; and
(ii) survives and continues after performance of this Agreement.
Continuing Performance. Each party is required to continue to perform its obligations under this contract pending final resolution of any dispute arising out of or relating to this contract, unless to do so would be impossible or impracticable under the circumstances.
Continuing Performance. (a) The provisions of this document do not merge with any action performed or document executed by any party for the purposes of performance of this document.
(b) Any representation in this document survives the execution of any document for the purposes of, and continues after, performance of this document.
(c) Any indemnity agreed by any party under this document:
(i) constitutes a liability of that party separate and independent from any other liability of that party under this document or any other agreement; and
(ii) survives and continues after performance of this document.
Continuing Performance. Contractor shall proceed diligently with its performance as directed by Owner, regardless of any pending Claim, unless otherwise agreed to by Owner in writing. Owner shall continue to make payments of undisputed amounts due in accordance with the Contract Documents during the pendency of any Claim.
Continuing Performance. 1 Both the Seller and the Purchaser shall execute and perform and cause or procure to execute and perform all such other documents, acts and things as may be required by or incidental to the preparation, execution, completion and performance of this Agreement and the documents and transactions contemplated hereby.

Continuing Performance. During the arbitration, the Parties shall perform those portions of the Contract over which there is no dispute between the Parties and which are not subject to arbitration. CHAPTER 17 FORCE MAJEURE
Continuing Performance. Professional shall continue performing services and Owner shall continue paying undisputed amounts due Professional during the pendency of disputes; provided, however, nothing in this Section shall be deemed to limit a Party’s rights hereunder to terminate this Agreement.
