Common use of CONTRACT AWARD DETERMINATION Clause in Contracts

CONTRACT AWARD DETERMINATION. a. The Additive bids are prioritized in the order they are listed. After the letting, the low bidder will be determined by considering the Base bid plus the total of any Additive bid accepted in the order of priority listed. b. The Secretary may accept or reject any or all Additive bids except as limited by the order of priority. c. The Secretary may award the contract in excess of the planned amount, if it would not change the low bidder using the planned amount. d. The bidder waives the right to claim the bidder misunderstood the terms, conditions, and provisions of this Additive Bidding specification. This specification modifies subsection 103.1 “AWARD OF CONTRACT” for purposes of calculating the lowest cost.
