Common use of Contract Capacity; Declared Contract Capacity Clause in Contracts

Contract Capacity; Declared Contract Capacity. The capacity of the Project at any time shall be the lower of the following: (A) [____] MW of Declared Contract Capacity or (B) the Net Rated Output Capacity of the Project (the “Contract Capacity”). Throughout the Delivery Term, Seller shall sell and Schedule all Product produced by the Project solely to Buyer and in no event shall Buyer be obligated to receive or pay for, in any hour, any Product, as measured by Delivered Energy that exceeds the Contract Capacity.
