Common use of Contract Documentation, Confirmations and Conditions Clause in Contracts

Contract Documentation, Confirmations and Conditions. (a) Aron’s obligations to deliver Crude Oil under this Agreement shall be subject to (i) the Company’s identifying and negotiating potential Procurement Contracts, in accordance with Section 5.3, that are acceptable to both the Company and Xxxx relating to a sufficient quantity of Crude Oil to meet the Refinery’s requirements, (ii) the Company’s performing its obligations hereunder with respect to providing Xxxx with timely nominations, forecasts and projections (including Projected Monthly Run Volumes, as contemplated in Section 5.4(a)) so that Xxxx may make timely nominations under the Procurement Contracts, (iii) all of the terms and conditions of the Procurement Contracts, (iv) any other condition set forth in Section 5.1 above and (v) no Event of Default having occurred and continuing with respect to the Company.

(a) Aron’s 's obligations to deliver Crude Oil under this Agreement shall be subject to (i) the Company’s 's identifying and negotiating potential Procurement Contracts, NY2-683668 in accordance with Section 5.3, that are acceptable to both the Company and Xxxx Axxx relating to a sufficient quantity of Crude Oil to meet the Refinery’s 's requirements, (ii) the Company’s 's performing its obligations hereunder with respect to providing Xxxx Axxx with timely nominations, forecasts and projections (including Projected Monthly Run Volumes, as contemplated in Section 5.4(a)) so that Xxxx Axxx may make timely nominations under the Procurement Contracts, (iii) all of the terms and conditions of the Procurement Contracts, (iv) any other condition set forth in Section 5.1 above and (v) no Event of Default having occurred and continuing with respect to the Company.
