Common use of Contract or Restriction Affecting Borrower Clause in Contracts

Contract or Restriction Affecting Borrower. Borrower is not a party to nor is it bound by any contract or agreement or subject to any charter or other corporate restrictions, or subject to the renegotiation of any contract, which does or may materially and adversely affect the business, properties or condition, financial or otherwise, of Borrower, except for any contract, agreement or restrictions disclosed or reflected in the financial statements and notes thereto described in Section 2.3 hereof or as otherwise disclosed to the Bank from time to time.

Contract or Restriction Affecting Borrower. The Borrower is not a party to nor is it or bound by any contract or agreement or subject to any charter or other corporate restrictions, restriction that materially and adversely affects or subject to the renegotiation of any contract, which does or may will materially and adversely affect the business, properties or condition, financial or otherwise, of the Borrower, except for any contract, agreement or restrictions disclosed or reflected in the financial statements and notes thereto described in Section 2.3 hereof or as otherwise disclosed to the Bank from time to time.

The Borrower neither is not a party to nor is it bound by any contract or agreement or subject to any charter articles of incorporation, bylaws or other corporate restrictions, or subject to the renegotiation of any contract, restrictions which does or may materially and adversely affect affects the business, properties properties, or condition, financial or otherwise, of the Borrower, except for any contract, agreement or restrictions disclosed or reflected in the financial statements and notes thereto described in Section 2.3 hereof or as otherwise disclosed to the Bank from time to time.
