Common use of Contractor Losses Clause in Contracts

Contractor Losses. Where: (a) a Contractor is entitled to claim any compensation and/or relief from the Development Entity under any Contract; and (b) the Development Entity subsequently makes a claim against the Department under this PPA in relation to such compensation and/or relief, the Department waives any right to defend the Development Entity’s claim on the ground that the Development Entity is only required to pay compensation or grant relief to the Contractor under the relevant Contract to the extent that the same is recoverable from the Department.
