Common use of Contractor’s Ancillary Warranty Obligations Clause in Contracts

Contractor’s Ancillary Warranty Obligations. All warranties include all labor, and all equipment and materials installed, and shall be signed by and delivered to the Contractor and countersigned by the Subcontractor performing the same and/or the manufacturer thereof, as the case may be. As of the time of Substantial Completion of the Work, the Contractor agrees to assign to Owner any and all Contractor’s personnel and manufacturers’ warranties relating to labor, equipment and materials installed in the Work. Contractor further agrees to perform the Work in such manner so as to preserve any and all such manufacturers’ warranties. In addition to the foregoing, the Contractor shall comply with all other warranties referred to in any other provision of the Contract Documents. Where more than one warranty obligation applies hereunder, the more stringent warranty obligation shall govern.
