Contractor’s Assistance. 4-400 General.
(a) Contractor's assistance in screening shall be requested on provisioned and replenishment parts after consideration of the benefit expected from the contractor's technical information and the cost to the Government of obtaining such assistance.
(b) Contractor's assistance shall not be requested for parts covered by Government/industry specifications, commercially available parts or parts for which data is already available.
(c) Arrangements entered into with contractors to obtain technical information shall provide that—
(1) Contractors will exert their best effort to make impartial technical evaluations using applicable technical data and the experience of competent personnel; and
(2) No costs to the Government will be incurred for duplicate screening of parts. 4-401 Contractor's technical evaluation procedures.
(a) Contractor's technical evaluation for the screening process shall be required contractually by incorporating MIL-STD-789, which delineates the contractor's responsibilities and procedures and prescribes use of the contractor DD Form 1418, Technical Information Record, and the DD Form 1418-1, Technical Data Identification Checklist, a copy of each document listed on DD Form 1418-1, and other substantive data that was used in developing the contractor's recommendations.
(b) When MIL-STD-789 is incorporated in a contract, the DD Form 1423, Contract Data Requirements List, shall specify the requirement for the submission of DD Form 1418, Technical Information Record, and DD Form 1418-1, Technical Data Identification Checklist, in accordance with MIL-STD-789.
Contractor’s Assistance. Contractor shall cooperate with Owner in obtaining and maintaining the insurance policies of Owner and shall provide all Drawings, Final Plans, certificates and other information that Owner or its insurers may reasonably require. Contractor shall with all due diligence comply with the conditions of Owner’s insurance polices and all reasonable requirements of the insurers in connection with the settlement of claims, the recovery of losses and the prevention of accidents and shall bear at its own cost the consequences of any failure to do so.
Contractor’s Assistance. The Contractor must provide to the State all reasonable facilities and assistance to enable the State to fully exercise its rights under this clause.

Contractor’s Assistance. In the event a loss is sustained under any of Company’s policies, such loss will be adjusted by Company with the insurance companies. Contractor will assist Company in the adjustment of losses and shall cooperate fully and expeditiously with Company in Company’s pursuit of insurance coverage. Contractor shall replace or repair any loss or damage and complete the Work in accordance with the Contract Documents (subject to any right, if any, Contractor may have to receive compensation therefor under this Agreement). Contractor shall provide all Drawings, Final Plans, certificates and other information that Company or its insurers may reasonably require. Contractor’s Assistance. Subject to the terms and conditions herein including without limitation the payment of Contracting Costs (as defined in Exhibit B), a Contracting Entity (as defined in Exhibit B) shall upon the request of a Fulfilling Entity (as defined in Exhibit B), provide reasonable assistance to a Fulfilling Entity in connection with the fulfillment of obligations under a Supply Contract (as defined in Exhibit B). Each PPC-US and PPC-BV acknowledge and agree that PPC-US shall provide Contractor's Assistance to PPC-BV Entities in connection with the fulfillment of obligations under PPC- US's Supply Contract with Ford and PPC-US's Supply Contract with Delta.
Contractor’s Assistance. In the event a loss is sustained under any of FPL’s policies, such loss will be adjusted by FPL and/or the Financing Parties with the insurance companies. Contractor will assist FPL and the Financing Parties in the adjustment of losses. In the event a loss is sustained under the Builder’s Risk Policy, such loss will be adjusted by Contractor and FPL with the insurance companies. FPL and Contractor agree to waive all rights of recovery against each other, and shall cause their respective underwriters to waive all rights of subrogation, for damages caused by fire and/or other perils to the extent covered and paid for by the Cargo Insurance. Upon FPL’s reasonable request, Contractor shall with all due diligence comply with the conditions of FPL’s insurance polices and all reasonable requirements of the insurers in connection with the settlement of claims, the recovery of losses and the prevention of accidents and shall bear at its own cost the consequences of any failure to do so.
Contractor’s Assistance. The Contractor will ensure that the Contractor’s Representative is available at all reasonable times to assist and accompany the Company’s Representative and any other person authorised by the Company to inspect the Works.

The parties will bear their respective costs in cooperating in the pursuit of such insurance coverage. The duty to cooperate shall survive any termination of the Agreement.
