CONTRACTOR’S DUTY TO PERFORM Sample Clauses

CONTRACTOR’S DUTY TO PERFORM. The CONTRACTOR’S obligation to perform and complete the work and provide all Services in accordance with this Contract shall be absolute. Observations made by the CITY, recommendation of any progress or final payment by the CITY, and any determination that work appears to be substantially completed or any payment by CITY to the CONTRACTOR under the Contract; or any use of or reliance upon the work or any part thereof by the CITY, shall not act as a waiver or release of the CONTRACTOR’S duties to provide all services in accordance with the requirements of this contract.
CONTRACTOR’S DUTY TO PERFORM. Neither the occurrence of an event constituting an alleged breach of contract nor the pending status of any claim for breach of contract is grounds for the suspension of performance, in whole or in part, by CONTRACTOR of any duty or obligation with respect to the performance of this Agreement. Any changes to the Agreement as a result of a Dispute Resolution will be implemented in accordance with Article 8, Amendments, Modifications and Change Orders.
