CONTRACTOR’S REPRESENTATIONS. In order to induce the TOWN to enter into this Agreement CONTRACTOR makes the following representations and commitments: 5.1 CONTRACTOR has examined and carefully studied the Contract Documents, (including any and all Addenda) and the other related data identified in the Bidding Documents including "technical". 5.2 CONTRACTOR has inspected the site and become familiar with and is satisfied as to the general, local and site conditions that may affect cost, progress, performance or furnishing of the Work. 5.3 CONTRACTOR is familiar with and is satisfied as to all federal, state and local Laws and Regulations that may affect cost, progress and furnishing of the Work. 5.4 CONTRACTOR has carefully studied all reports of exploration and tests of subsurface conditions at or contiguous to the site and all drawings of physical conditions relating to surface or subsurface structures (except Underground Facilities) at or contiguous to the site which have been identified in the General Conditions. CONTRACTOR accepts the determination set forth in said General Conditions. CONTRACTOR acknowledges that such reports and drawings are not CONTRACT DOCUMENTS and may not be complete for CONTRACTOR's purposes. CONTRACTOR acknowledges that the TOWN and the Project Manager do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents with respect to such reports, drawings or to Underground Facilities at or contiguous to the site. CONTRACTOR has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction to be employed by CONTRACTOR and safety precautions and programs incident thereto. CONTRACTOR does not consider that any additional examinations, investigations, explorations, tests, studies or data are necessary for the performance and furnishing of the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents. 5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract Price, within the Contract Time and in accordance with the other terms and conditions of the Contract Documents, including specifically the General Conditions. 5.5 CONTRACTOR is aware of the general nature of work to be performed by the TOWN and others at the site that relates to the Work as indicated in the Contract Documents. 5.6 CONTRACTOR has correlated the information known to CONTRACTOR, information and observations obtained from visits to the site, reports and drawings identified in the Contract Documents and all additional examinations, investigations, explorations, tests studies and data with the Contract Documents. 5.7 CONTRACTOR has given the Project Manager written notice of all conflicts, errors, ambiguities or discrepancies that CONTRACTOR has discovered in the Contract Documents and the written resolution thereof by the Project Manager is acceptable to CONTRACTOR, and the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing the Work. 5.8 CONTRACTOR will use its best skill and workmanship to provide Work of the highest quality.

CONTRACTOR The Contractor acknowledges that such reports and drawings are not CONTRACT DOCUMENTS Contract Documents and may not be complete for CONTRACTOR's the Contractor’s purposes. CONTRACTOR The Contractor acknowledges that the TOWN City and the Project Manager do Design Professional shall not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents with respect to such reports, drawings or to Underground Facilities at or contiguous to the site. CONTRACTOR The Contractor has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary such additional supplementary examinations, investigations, explorations, tests, studies, studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction to be employed by CONTRACTOR the Contractor and safety precautions and programs incident theretohereto. CONTRACTOR The Contractor does not consider that any additional examinations, investigations, explorations, tests, studies or data are necessary for the performance and furnishing of the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents.
5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. 5.6 CONTRACTOR 8.6 The Contractor has correlated the information known to CONTRACTORthe Contractor, information and observations obtained from visits to the site, reports and drawings identified in the Contract Documents and all additional examinations, investigations, explorations, tests tests, studies and data with the Contract Documents.

CONTRACTOR acknowledges that of a Hazardous Environmental Condition, if any, at the TOWN and the Project Manager do not assume responsibility for the accuracy or completeness of information and data shown or indicated Site which has been identified in the Contract Documents with respect to such reports, drawings or to Underground Facilities at or contiguous to Supplementary Conditions as provided in paragraph 4.06 of the site. E. 5.7 7.7 The CONTRACTOR has given the Project Manager VILLAGE’S REPRESENTATIVE written notice of all conflicts, errors, ambiguities or discrepancies that CONTRACTOR has discovered in the Contract Documents and the written resolution thereof by the Project Manager VILLAGE’S REPRESENTATIVE is acceptable to CONTRACTOR, and the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work.
5.8 7.8 The CONTRACTOR warrants the following:
7.8.1 Anti‐Discrimination: The CONTRACTOR agrees that it will use its best skill not discriminate against any employees or applicants for employment or against persons for any other benefit or service under this Contract because of race, color, religion, sex, national origin, or physical or mental handicap where the handicap does not affect the ability of an individual to perform in a position of employment, and workmanship to provide Work abide by all federal and state laws regarding non‐discrimination.
7.8.2 Anti‐Kickback: The CONTRACTOR warrants that no person has been employed or retained to solicit or secure this Contract upon an agreement or understanding for a commission, percentage, brokerage or contingent fee, and that no employee or officer of the highest qualityVILLAGE or any other applicable federal or state agency, has any interest, financially or otherwise, in the Project. For breach or violation of this warranty, the VILLAGE shall have the right to annul this Contract without liability or, in its discretion, to deduct from the Contract Price or consideration, the full amount of such commission, percentage, brokerage or contingent fee.

5.2 CONTRACTOR 7.02 Contractor has inspected visited the site and become familiar with and is satisfied as to the general, local local, and site conditions that may affect cost, progress, performance or and furnishing of the Work.
5.3 CONTRACTOR 7.03 Contractor is familiar with and is satisfied as to all federal, state state, and local Laws and Regulations that may affect cost, progress progress, performance, and furnishing of the Work.
5.4 CONTRACTOR 7.04 Contractor has carefully studied all reports of exploration explorations and tests of subsurface conditions at or contiguous to the site and all drawings of physical conditions in or relating to existing surface or subsurface structures (except Underground Facilities) at or contiguous to the site (except underground facilities) which have been identified in the Supplementary Conditions as provided in Paragraph 5.03.A of the General Conditions. CONTRACTOR Contractor accepts the determination set forth in said Paragraph SC 5.03 of the Supplementary Conditions of the extent of the “technical data” contained in such reports and drawings upon which Contractor is entitled to rely as provided in Paragraph 5.03 of the General Conditions. CONTRACTOR Contractor acknowledges that such reports and drawings are not CONTRACT DOCUMENTS Contract Documents and may not be complete for CONTRACTOR's Contractor’s purposes. CONTRACTOR Contractor acknowledges that the TOWN Owner and the Project Manager Engineer do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents with respect to such reports, drawings or to Underground Facilities at or contiguous to the site. CONTRACTOR Contractor has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary such additional supplementary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface, subsurface subsurface, and Underground Facilities) at or contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences sequences, and procedures of or construction to be the employed by CONTRACTOR Contractor and safety precautions and programs incident thereto. CONTRACTOR Contractor does not consider that any additional examinations, investigations, explorations, tests, studies studies, or data are necessary for the performance and furnishing of the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents.
5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract Price, within the Contract Time and in accordance with the other terms and conditions of the Contract Documents, including specifically the General Conditions.
5.5 CONTRACTOR is aware of the general nature of work to be performed by the TOWN and others at the site that relates to the Work as indicated in the Contract Documents.
5.6 CONTRACTOR 7.05 Contractor has correlated the information known to CONTRACTORContractor, information and observations obtained from visits to the site, reports reports, and drawings identified in the Contract Documents and all additional examinations, investigations, explorations, tests tests, studies and data with the Contract Documents.
5.7 CONTRACTOR 7.06 Contractor has given the Project Manager Engineer written notice of all conflicts, errors, ambiguities or discrepancies that CONTRACTOR Contractor has discovered in the Contract Documents and the written resolution thereof by the Project Manager Engineer is acceptable to CONTRACTORContractor, and the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work.
5.8 CONTRACTOR will use its best skill 7.07 Contractor hereby covenants and workmanship agrees to provide Work pay all claims for labor, services, materials, plans, or specifications performed, furnished, procured, used, or consumed that pertains to the public improvement or public work.
7.08 Contractor agrees to extent practicable, to maintain a list of all subcontractors, suppliers, and service providers performing, furnishing, or procuring labor, services, materials, plans, or specifications under the Contract.
7.08.1 Subcontractor, supplier, or service provider means the following: Any person who has direct contractual relationship, expressed or implied, with the Prime Contractor or with any subcontractor of the highest qualityPrime Contractor to perform, furnish, or procure labor, services, materials, plans, or specifications.

E. CONTRACTOR has obtained and carefully studied (or assumes responsibility for doing so) all additional or supplementary examinations, investigations, explorations, tests studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site Site which have been identified in may affect cost, progress or performance of the General Conditions. CONTRACTOR accepts Work or which relate to any aspect of the determination set forth in said General Conditions. means, methods or techniques or procedures of construction engaged by CONTRACTOR, including applying precise means, methods and techniques or procedures of construction, if any, expressly required by the CONTRACT DOCUMENTS to be employed by XXXXXXXXX, and safety precautions and programs incident thereto.
X. CONTRACTOR acknowledges that such reports OWNER and drawings are not CONTRACT DOCUMENTS and may not be complete for CONTRACTOR's purposes. CONTRACTOR acknowledges that the TOWN and the Project Manager ARCHITECT do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents CONTRACT DOCUMENTS with respect to such reports, drawings or to Underground Facilities at or contiguous to the site. .
G. CONTRACTOR has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary additional or supplementary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site or otherwise Site which may affect cost, progress, or performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction construction, if any, expressly required by the CONTRACT DOCUMENTS to be employed by CONTRACTOR CONTRACTOR, and safety precautions and programs incident thereto. .
H. CONTRACTOR Contractor has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary such additional supplementary examinations, investigations, explorations, tests, studies, studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site Site or otherwise which may affect cost, progress, performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction to be employed by CONTRACTOR Contractor and safety precautions and programs incident thereto. CONTRACTOR Contractor does not consider that any additional examinations, investigations, explorations, tests, studies or data are necessary for the performance and furnishing of the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents.
5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract Price, within the Contract Time and in accordance with the other terms and conditions of the Contract Documents, including specifically the General Conditions.
5.5 CONTRACTOR 6.5 Contractor is aware of the general nature of work to be performed by the TOWN Owner and others at the site Site that relates to the Work as indicated in the Contract Documents.

5.8 CONTRACTOR will use its best skill and workmanship to provide Work 6.8 Contractor certifies by signing this Agreement that no Commissioner or employee of the highest qualityHighlands County Board of County Commissioners has solicited or accepted gratuities, favors, or anything of monetary value from Contractor or parties to subcontracts. 5.8 CONTRACTOR will use 8.8 Contractor shall make prompt payment to its best skill subcontractors and workmanship suppliers for amounts owed for work performed on the construction project within seven days after receipt of payment from the City. If Contractor fails to provide Work pay Contractor’s subcontractor and suppliers by first-class mail or hand delivery within seven days of receipt of payment, Contractor shall pay interest to Contractor’s subcontractors and suppliers beginning on the eight day after payment was due, computed at one and one-half percent of the highest qualityundisputed amount per month or fraction of a month until payment is issued. CONTRACTOR’S REPRESENTATIONS. In order to induce the TOWN Owner to enter into this Agreement CONTRACTOR Agreement, Contractor makes the following representations and commitmentsrepresentations:
5.1 CONTRACTOR 6.1 Contractor has examined and carefully studied the Contract Documents, Documents (including any and all Addenda) and the other related data identified in the Bidding Documents including "technical"ITB 17-039 Documents.
5.2 CONTRACTOR 6.2 Contractor has inspected visited the site Site and become familiar with and is satisfied as to the general, local and site Site conditions that may affect cost, progress, performance or furnishing of the Work.
5.3 CONTRACTOR 6.3 Contractor is familiar with and is satisfied as to will comply with all federal, state and local Laws and Regulations that may whether or not the Laws or Regulations affect cost, progress progress, performance and furnishing of the Work.
5.4 CONTRACTOR 6.4 Contractor has carefully studied all reports of exploration explorations and tests of subsurface conditions at or contiguous to the site Site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the Site (except Underground Facilities) at or contiguous to the site which have been identified in the General Conditions. CONTRACTOR accepts the determination set forth in said General Conditions. CONTRACTOR Contractor acknowledges that such reports and drawings are not CONTRACT DOCUMENTS Contract Documents and may not be complete for CONTRACTORContractor's purposes. CONTRACTOR Contractor acknowledges that the TOWN Owner and the Project Manager Engineer do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents with respect to such reports, drawings or to Underground Facilities at or contiguous to the siteSite. CONTRACTOR Contractor has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary such additional supplementary examinations, investigations, explorations, tests, studies, studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site Site or otherwise which may affect cost, progress, performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction to be employed by CONTRACTOR Contractor and safety precautions and programs incident thereto. CONTRACTOR Contractor does not consider that any additional examinations, investigations, explorations, tests, studies or data are necessary for the performance and furnishing of the Work at the Contract Price, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents.
5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract Price, within the Contract Time and in accordance with the other terms and conditions of the Contract Documents, including specifically the General Conditions.
5.5 CONTRACTOR 6.5 Contractor is aware of the general nature of work to be performed by the TOWN Owner and others at the site Site that relates to the Work as indicated in the Contract Documents.
5.6 CONTRACTOR 6.6 Contractor has correlated the information known to CONTRACTORContractor, information and observations obtained from visits to the siteSite, reports reports, Drawings and drawings Specifications identified in the Contract Documents and all additional examinations, investigations, explorations, tests tests, studies and data with the Contract Documents.
5.7 CONTRACTOR 6.7 Contractor has not given the Project Manager Engineer written notice of all any conflicts, errors, ambiguities or discrepancies that CONTRACTOR Contractor has discovered in the Contract Documents and the written resolution thereof by the Project Manager is acceptable to CONTRACTORDocuments, and Contractor agrees that the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work.
5.8 CONTRACTOR will use its best skill and workmanship to provide Work 6.8 Contractor certifies by signing this Agreement that no Commissioner or employee of the highest qualityHighlands County Board of County Commissioners has solicited or accepted gratuities, favors, or anything of monetary value from Contractor or parties to subcontracts. Contractor and Subcontractors shall not pay any gratuities, favors, or anything of monetary value to any Commissioner or employee of the Highlands County Board of County Commissioners.

CONTRACTOR acknowledges that the TOWN OWNER and the Project Manager PRINCIPAL ARCHITECT/ENGINEER do not assume and expressly disclaim any responsibility for the accuracy or completeness of the information and data shown or indicated in the Contract Documents with respect to such reports, drawings subsurface conditions or to Underground Facilities at or contiguous to the siteSite or CONTRACTOR'S interpretation of such information and data. CONTRACTOR has given PRINCIPAL ARCHITECT/ENGINEER through the Project Manager OWNER or OWNER’S Representative written notice of all conflicts, errors, ambiguities ambiguities, or discrepancies that CONTRACTOR has discovered in the Contract Documents and the written resolution thereof by the Project Manager PRINCIPAL ARCHITECT/ENGINEER is acceptable to CONTRACTOR, and the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work.
5.8 CONTRACTOR will use its best skill and workmanship . Pursuant to provide Work Section 2270.002 of the highest qualityTexas Government Code, contemporaneous with CONTRACTOR’s execution of this Agreement, CONTRACTOR shall execute the Verification Company Does Not Boycott Israel, attached hereto and incorporated herein.

5.4 CONTRACTOR has carefully studied all reports of exploration and tests of subsurface conditions at or contiguous to the site and all drawings of physical conditions relating to surface or subsurface structures (except Underground Facilities) at or contiguous to the site which have been identified in the General Conditions. CONTRACTOR accepts the determination set forth in said General Conditions. CONTRACTOR acknowledges that such reports and drawings are not CONTRACT DOCUMENTS and may not be complete for CONTRACTOR's purposes. CONTRACTOR acknowledges that the TOWN and the Project Manager do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents with respect to such reports, drawings or to Underground Facilities at or contiguous to the site. CONTRACTOR has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and or procedures of construction to be employed by CONTRACTOR Contractor and safety saf ety precautions and programs incident thereto.
5.2 Contractor has examined thoroughly and understood all reports of exploration and tests of subsurf ace conditions, as-built drawings, drawings, products specifications, or reports, available for Bidding purposes, of physical conditions, including Underground Facilities, which are identified in Document 003119 (Existing Condition Inf ormation), or which may appear in the Drawings. CONTRACTOR Contractor accepts the determination set forth in these Documents and Document 007200 (General Conditions) of the limited extent of the inf ormation contained in such materials upon which Contractor may be entitled to rely. Contractor agrees that, except for the inf ormation so identif ied, Contractor does not consider that and shall not rely on any additional other inf ormation contained in such reports and drawings.
5.3 Contractor has conducted or obtained and has understood all such examinations, investigations, explorations, tests, reports and studies (in addition to or data are necessary for to supplement those ref erred to in Section 5.2 of this Document 005213) that pertain to the performance and furnishing of the Work at the Contract Pricesubsurface conditions, within the Contract Times and in accordance with the other terms and conditions of the Contract Documents.
5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing as-built conditions, Underground Facilities and all other physical conditions at or contiguous to the site and assumes responsibility Site or otherwise that may affect the cost, progress, performance or furnishing of Work, as Contractor considers necessary for the accurate location perf ormance or f urnishing of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract PriceSum, within the Contract Time and in accordance with the other terms and conditions of the Contract Documents, including specifically specif ically the provisions of Document 007200 (General Conditions.
5.5 CONTRACTOR is aware of the general nature of work to be performed by the TOWN ); and others at the site that relates to the Work as indicated in the Contract Documents.
5.6 CONTRACTOR has correlated the information known to CONTRACTOR, information and observations obtained from visits to the site, reports and drawings identified in the Contract Documents and all no additional examinations, investigations, explorations, tests tests, reports, studies or similar information or data are or will be required by Contractor f or such purposes.
5.4 Contractor has correlated its knowledge and data the results of all such observations, examinations, investigations, explorations, tests, reports and studies with the terms and conditions of the Contract Documents.
5.7 CONTRACTOR 5.5 Contractor has given the Project Manager County prompt written notice of all conflictsconf licts, errors, ambiguities ambiguities, or discrepancies that CONTRACTOR it has discovered in or among the Contract Documents and as-built drawings and actual conditions and the written resolution thereof through Addenda issued by the Project Manager County is acceptable to CONTRACTORContractor.
5.6 Contractor is duly organized, existing and in good standing under applicable state law, and is duly qualif ied to conduct business in the State of Calif ornia.
5.7 Contractor has duly authorized the execution, delivery and perf ormance of this Agreement, the other Contract Documents, and the Work to be perf ormed herein. The Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing the Workdo not violate or create a def xxxx under any instrument, agreement, order, or decree binding on Contractor.

CONTRACTOR has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary additional or supplementary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface, subsurface subsurface, and Underground Facilities) at or contiguous to the site or otherwise Site which may affect cost, progress, or performance or furnishing of the Work or which relate to any aspect anyaspect of the means, methods, techniques, sequences sequences, and procedures of construction to be employed by CONTRACTOR CONTRACTOR, including applying the specific means, methods, techniques, sequences, and procedures of construction, if any, expressly required by the Contract Documents to be employed by CONTRACTOR, and safety precautions and programs incident thereto.
F. CONTRACTOR does not consider that any additional further examinations, investigations, explorations, tests, studies studies, or data are necessary for the performance and furnishing of the Work at the Contract Price, within the Contract Times Times, and in accordance with the other terms and conditions of the Contract Documents.
5.4.1 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. 5.4.1 5.5 CONTRACTOR has reviewed and checked all information and data shown or indicated on the Contract Documents with respect to existing Underground Facilities at or contiguous to the site and assumes responsibility for the accurate location of said Underground Facilities. No additional examinations, investigations, explorations, tests, reports, studies or similar information or data in respect of said Underground Facilities are or will be required by CONTRACTOR in order to perform and furnish the Work at the Contract Price, within the Contract Time and in accordance with the other terms and conditions of the Contract Documents, including specifically the General Conditions.
5.5 5.6 CONTRACTOR is aware of the general nature of work to be performed by the TOWN and others at the site that relates to the Work as indicated in the Contract Documents.

5.7 5.8 CONTRACTOR has given the Project Manager written notice of all conflicts, errors, ambiguities or discrepancies that CONTRACTOR has discovered in the Contract Documents and the written resolution thereof by the Project Manager is acceptable to CONTRACTOR, and the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing the Work.
5.8 5.9 CONTRACTOR will use its best skill and workmanship to provide Work of the highest quality.

E. CONTRACTOR has obtained and carefully studied (or assumes responsibility for doing so) all additional or supplementary examinations, investigations, explorations, tests studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site Site which have been identified in may affect cost, progress or performance of the General Conditions. CONTRACTOR accepts Work or which relate to any aspect of the determination set forth in said General Conditions. means, methods or techniques or procedures of construction engaged by CONTRACTOR, including applying precise means, methods and techniques or procedures of construction, if any, expressly required by the CONTRACT DOCUMENTS to be employed by CONTRATOR, and safety precautions and programs incident thereto.
F. CONTRACTOR acknowledges that such reports OWNER and drawings are not CONTRACT DOCUMENTS and may not be complete for CONTRACTOR's purposes. CONTRACTOR acknowledges that the TOWN and the Project Manager ARCHITECT do not assume responsibility for the accuracy or completeness of information and data shown or indicated in the Contract Documents CONTRACT DOCUMENTS with respect to such reports, drawings or to Underground Facilities at or contiguous to the site. .
G. CONTRACTOR has conducted, obtained and carefully studied (or assumes responsibility for having done so) all necessary additional or supplementary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the site or otherwise Site which may affect cost, progress, or performance or furnishing of the Work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction construction, if any, expressly required by the CONTRACT DOCUMENTS to be employed by CONTRACTOR CONTRACTOR, and safety precautions and programs incident thereto. .
H. 5.7 CONTRACTOR 6.07 Contractor has not given the Project Manager written notice of all any conflicts, errors, ambiguities or discrepancies that CONTRACTOR Contractor has discovered in the Contract Documents and the written resolution thereof by the Project Manager is acceptable to CONTRACTORDocuments, and Contractor agrees that the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work.
5.8 CONTRACTOR will use its best skill and workmanship to provide Work 6.08 Contractor certifies by signing this Agreement that no Commissioner or employee of the highest qualityHighlands County Board of County Commissioners has solicited or accepted gratuities, favors, or anything of monetary value from Contractor or parties to subcontracts. Contractor and Subcontractors shall not pay any gratuities, favors, or anything of monetary value to any Commissioner or employee of the Highlands County Board of County Commissioners.
6.09 Contractor and all subcontractors to the fullest extent permitted by Laws and Regulations, and in addition to any other obligations of Contractor under this Agreement or otherwise, Contractor shall indemnify and hold harmless Owner and Owner’s officers and employees and the State of Florida Department of Transportation, including the Department’s officers and employees, from and against all liabilities, damages, losses, and costs, including, but not limited to, reasonable attorney’s fees to the extent caused by the negligence, recklessness, or intentional wrongful misconduct of Contractor and persons employed or utilized by Contractor in the performance of any of the Work.
6.10 Contractor agrees to comply with Section 20.055(5), Florida Statutes, and to incorporate in all subcontracts the obligation to comply with Section 20.055(5), Florida Statutes. Section 20.055(5), Florida Statutes describes the duty of the Contractor and subcontractor(s) to comply with requests from the Inspector General, if required.

5.5 CONTRACTOR is aware of the general nature of work to be performed by the TOWN and others at the site that relates to the Work as indicated in the Contract Documents.
