CONTRACTUAL POSITION. 4.1 The Shared Employee will remain the employee of the Employing Authority throughout the period of the availability. The contract of employment and all terms and conditions of employment of the Shared Employee shall be those which are set and agreed by the Employing Authority and shall continue subject to any changes made by the Employing Authority in respect of pay increases or otherwise.
4.2 The period of the availability shall not constitute a break in service of the Shared Employee.
4.3 Payment of salary/wages in accordance with the Shared Employee’s contract of employment will be made by the Employing Authority. The employee will return to a substantive post in the Employing Authority once the availability comes to an end.
4.4 Requests for leave, notices of sickness, claims for additional allowances and other matters requiring line management approval in accordance with the Shared Employee’s contract of employment shall be subject to approval by the line manager in the joint arrangement who shall seek clarification if necessary from the designated line manager in the Employing Authority.
4.5 The work performance of the Shared Employee shall be subject to any relevant procedures for review, appraisal and improvement as are operated by the Employing Authority. As and when necessary such procedures shall be carried out by the designated line manager of the Employing Authority with the co-operation of the designated line manager of the joint arrangement. Where in the opinion of the Project Administering Authority the Shared Employee’s performance warrants the implementation of further formal procedures, such procedures shall not be implemented until any relevant preliminary steps for performance management required under the Shared Employee’s conditions of service have been applied.
4.6 Day to day supervision of the Shared Employee shall be the responsibility of the Project Administering Authority. Should there be a need for formal disciplinary action (that is any disciplinary action which could result in a record being placed on the Shared Employee’s personal file) the Project Administering Authority will inform the Employing Authority who will be responsible for implementing the Employing Authority’s disciplinary procedure. The Project Administering Authority shall be required to provide evidence of the circumstances giving rise to the disciplinary action to the Employing Authority and to any disciplinary panels constituted by the Employing Authority....
