Control of Stockholder Suits. At least until the Expiration Date, the Company, under the direction of the Board, will control any and all negotiations and decisions with respect to the Stockholder Suits, and Acquisition will not, and will cause the Three Cities Funds not to, communicate about the Stockholder Suits with counsel for the plaintiffs in the Stockholder Suits, the Company's insurance carriers or their counsel, or any other party involved in the Stockholder Suits, without the express prior consent of the Company or its counsel.
