Common use of Controlled Group Member Clause in Contracts

Controlled Group Member. Controlled group member means the Employer and each member of a controlled group of corporations (as defined in section 414(b) of the Code and as modified by section 415(h) of the Code), all commonly controlled trades or businesses (as defined in section 414(c) of the Code and as modified by section 415(h) of the Code), affiliated service groups (as defined in section 414(m) of the Code) of which the Employer is a part and other organizations required to be aggregated for this purpose under section 414(o) of the Code.

Controlled Group Member. Controlled group member means the Employer and each member of a controlled group of corporations (as defined in section 414(b) of the Code and as modified by Code section 415(h) of the Code), all commonly controlled trades or businesses (as defined in section 414(c) of the Code and as modified by Code section 415(h) of the Code), ) and affiliated service groups (as defined in section 414(m) of the Code) of which the Employer is a part and other organizations required to be aggregated for this purpose under section 414(o) of the Codepart.

Controlled Group Member. “Controlled group member means Group Member” shall mean each trade or business (whether or not incorporated) which together with the Employer and each member Company would be treated as a “single employer” within the meaning of a controlled group of corporations (as defined in section Code § 414(b) of the Code and as modified by section 415(h) of the Code), all commonly controlled trades or businesses (as defined in section 414(c) of the Code and as modified by section 415(h) of the Codec), affiliated service groups (as defined in section 414(mm), or (o), and includes all “leased employees” attributable to that single employer under Code § 414(n) of the Code) of which the Employer is a part and other organizations required to be aggregated for this purpose under section 414(o) of the Codeor (o).
