Cooperation During Pre-Construction. If the Project is constructed pursuant to a Construction Manager at Risk Agreement between Owner and the Contractor, the Architect/Engineer will cooperate with the Contractor during the Preconstruction Phase with the goal of achieving a cost-effective and constructible design. Such cooperation shall include providing design information to Contractor in a timely manner to enable Contractor to accurately determine the cost of the Project, reviewing the Contractor’s recommendations and replying to requests for information promptly, incorporating changes recommended by the Contractor and approved by Architect/Engineer and Owner in a timely manner, and notifying Owner if the Contractor and the Architect/Engineer are unable to agree on any change requested or recommended by the Contractor.
