Common use of Cost Pools Clause in Contracts

Cost Pools. Landlord shall have the right, from time to time, to equitably allocate some or all of the Operating Expenses and/or Insurance Expenses among different portions or occupants of the Building (the “Cost Pools”), in Landlord’s discretion. Such Cost Pools may, for example, include, but shall not be limited to, the office space tenants of the Building and the retail space tenants. The Operating Expenses and/or Insurance Expenses allocable to each such Cost Pool shall be allocated to such Cost Pool and charged to the tenants within such Cost Pool in an equitable manner.

Cost Pools. Landlord shall have the right, from time to time, to equitably allocate some or all of the Operating Direct Expenses and/or Insurance Expenses for the Project among different portions or occupants of the Building Project (the “Cost Pools”), in Landlord’s discretionaccordance with generally accepted accounting and management practices, consistently applied. Such Cost Pools may, for example, may include, but shall not be limited to, the office space tenants of a building of the Building Project or of the Project, and the retail space tenantstenants of a building of the Project or of the Project. The Operating Direct Expenses and/or Insurance Expenses allocable to within each such Cost Pool shall be allocated to such Cost Pool and charged to the tenants within such Cost Pool in an equitable mannermanner in accordance with generally accepted accounting and management practices, consistently applied.
