Common use of Costs of Suit Clause in Contracts

Costs of Suit. (a) If Lessee or Lessor shall bring any action for any relief against the other, declaratory or otherwise, arising out of this Lease, including any suit by Lessor for the recovery of rent or possession of the Premises, the losing party shall pay the successful party a reasonable sum for attorney's fees which shall be deemed to have accrued on the commencement of such action and shall be paid whether or not such action is prosecuted to judgement.

(a) If Lessee or Lessor shall bring any an action for any relief against the other, declaratory or otherwise, arising out of this Lease, including any suit by Lessor for the recovery of rent or possession of the Premises, the losing prevailing party shall pay be entitled to recover all reasonable costs and expenses associated with such action, including reasonable attorneys' fees, from the successful party a reasonable sum for attorney's fees which shall be deemed to have accrued on nonprevailing party, with the commencement of court or other tribunal hearing such action and shall be paid whether or not to make such action is prosecuted to judgementdeterminations.
